The following terms and conditions govern your use of carefirst.me (hereinafter referred to as “Site”) owned by Nayan Tarit Health Services Private Limited (hereinafter referred to as “we”, “us” or “our” or “Company”), having our registered office at Mascots CoWork, Times Square Building, 7th & 8th Flr,CTS349 & 349-1, Andheri (W) Mumbai, Maharashtra 400069, India.

As a visitor/customer of the Site you are advised to read the Terms of Use (“ToU”) carefully. By using the Site, you accept and agree to the terms and conditions under these ToU. This ToU was updated on July 31, 2021.

This Site offers services, including but not limited to nursing, physiotherapy, provision of medical equipment, doctor consultation and lab tests and such other home healthcare services, from time to time (hereinafter referred to as “Services”).

We put our utmost effort to ensure that relevant details of the Services on this Site are accurate; however, errors may occur. If we discover any error in the availability, pricing, or description of the Services we may correct it and if the order has been placed we may inform you of such change and request you to reconfirm your order or cancel it. It is always our best endeavour to give our customers a seamless experience of availing our Services and we are committed to solve any grievances that our customers may have while availing our Services.

The customers are advised to note that this Site is maintained to ensure that the customers are aware of terms of use of the said Site and do not, in any way cover the terms and conditions that would govern the availing of Services by the customers. The detailed terms and conditions shall be entered into while availing any of the Services provided by us and the said terms shall be made available to the customers to make an informed decision about availing the Services.

Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Site. If you are a minor i.e. under the age of 18 years but at least 13 years of age you may use the Site only under the supervision of a parent or legal guardian who agrees to be bound by these ToU. If your age is below 18 years your parents or legal guardians can transact on behalf of you if they are registered users. You are prohibited from purchasing any material which is for adult consumption and the sale of which to minors is prohibited.

The Company grants you a limited sub-license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of the Company. This license does not include any resale or commercial use of this site or its contents; any collection and use of any product or Service listings, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of the Company. All customers have to register and login for placing orders on the Site. You have to keep your account and registration details current and correct for communications related to your purchases from the Site. By agreeing to the terms and conditions, you agree to receive promotional communication and newsletters upon registration. The customer can opt out either by unsubscribing in “My Account” or by contacting the customer service.

1. That you will use the Services provided by the Site, its affiliates, consultants and contracted companies, for lawful purposes only and comply with all applicable laws and regulations while using and transacting on the Site.
2. You will provide authentic and true information in all instances where such information is requested of you. The Company reserves the right to confirm and validate the information and other details provided by you at any point of time. If upon confirmation your details are found not to be true (wholly or partly), it has the right in its sole discretion to reject the registration and debar you from using the Services and / or other affiliated websites without prior intimation whatsoever.
3. You authorise the Company to contact you for any transactional purposes related to your order/account.

5. That the address at which delivery of the Services ordered by you is to be made will be correct and proper in all respects.

And for that purpose, you further authorise Company to share/disclose the information to any third party service provider or any affiliates, group companies, their authorised agents or third party service providers.

For the purpose of this ToU, Intellectual Property Rights shall include trademark, copyright, patent, design, geographical trademark and such other proprietary rights that would be construed as Intellectual Property Rights in normal economic parlance. Access to this Site does not confer and shall not be considered as conferring upon anyone any license under any of the Company or any third party’s Intellectual Property Rights. All Intellectual Property Rights, in this Site are owned by or licensed to the Company. We and our affiliates are not liable for any incidental, consequential, indirect or punitive damages arising out of your access to, or use of, the Site or the operation of the Site or failure of the Site to operate or any damages or injury caused by, including but not limited to, any error, omission, interruption, defect, delay in operation of transmission, computer virus, or line failure. In any event, our total liability to you for all losses, damages, and causes of action (in contract, tort (including without limitation, negligence), or otherwise) will not be greater than the amount, if any, paid by you to access the Site. You agree to defend, indemnify and hold harmless the Company, its employees, directors, officers, agents and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney’s fees, caused by or arising out of claims based upon your actions or inactions, which may result in any loss or liability to the Company or any third party including but not limited to breach of any warranties, representations or undertakings or in relation to the non-fulfilment of any of your obligations under this ToU or arising out of the your violation of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of Intellectual Property or other rights. This clause shall survive the expiry or termination of this ToU.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of these terms and conditions for all purposes.

These ToU are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use the Site, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these ToU, we may terminate the same at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to the Website (or any part thereof).

These conditions are governed by and construed in accordance with the laws of India. You agree to submit to the exclusive jurisdiction of the courts at Mumbai.

The provisions contained in this ToU are enforceable independent of each other. If any provision is determined by the competent court to be unenforceable, the other provisions will continue in effect.

This ToU is effective as of July 31, 2021 and will come into effect except with respect to any changes in its provisions in future. The changes to the provisions of this ToU will come in effect immediately after being posted on this Site. We may change our ToU from time to time. If we do, we will abide by this ToU on our website which will bind to you as and when updated.

Your continued use of the Service after we post any modifications to the ToU on the Site will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified ToU.

If we make any material changes to this ToU, we will notify you either through the email address you have provided us, or by placing a prominent notice on the Site.
